Terms of Service

1. About these terms

These are the terms that apply when you use figrd. They're written to be clear - not to bury important things in legalese - but they are still a binding agreement, so please read them.

figrd is operated under ABN 62 646 753 794, based in Victoria, Australia. When we say “we”, “us”, or “figrd”, that's who we mean. When we say “you”, we mean the business using the platform and the person acting for it. When we say “the platform”, we mean the figrd web app, the figrd mobile app, and the features they provide.

By creating an account, or by using figrd after someone in your business adds you to its account, you're agreeing to these terms. If you're signing up on behalf of a business, you confirm you have authority to bind that business. Our Privacy Policy explains how we handle personal information and forms part of the picture, but these terms govern your use of the service.


2. What figrd is - and what it isn't

figrd is a job management and quoting platform built for Australian trade and service businesses. It helps you create quotes, schedule and manage jobs, send invoices, take payments, message your customers, track your costs, and understand whether your work is profitable.

figrd is a tool to help you run your business and make decisions. It is notaccounting software, financial advice, tax advice, or legal advice, and it doesn't replace your accountant, bookkeeper, or lawyer. You stay responsible for your business's pricing, tax, record-keeping, and legal obligations.


3. Who can use figrd

You need to be at least 18 years old and using figrd for a legitimate business to sign up. By signing up, you confirm this, and you confirm that the details you give us - your name, business name, ABN, and contact details - are accurate and kept up to date. We've built figrd for Australian trade and service businesses; you're welcome to use it from elsewhere, but the product, pricing, and these terms are designed for Australia.


4. Your account and your team

You're responsible for keeping your login credentials secure, and for making sure your team members do the same. Your subscription covers your whole business - figrd has no per-user pricing, so you can add as many team members as you need without extra cost.

The account owner controls who has access and what role they hold. Actions taken by people you've given access to are treated as actions of your business. If someone leaves your business, remove their access - that's your call to make, not ours.

If you think your account has been compromised, contact us at support@figrd.com.au straight away. You're responsible for activity that happens under your account unless you've notified us of a breach.


5. Free trials and beta features

If your account includes a free trial, the length is shown when you sign up. When the trial ends you'll need an active subscription to keep using paid features. Your data isn't deleted when a trial lapses - it's waiting for you if you subscribe.

Some parts of figrd may be offered as a beta, preview, or early access feature, and during a beta program that may be true of the platform as a whole. Beta features are provided so you can try them early. They may change, have rough edges, or be withdrawn, and they may not be covered by the same support expectations as the rest of the platform. We'll be upfront about what's beta.

If you give us feedback, ideas, or suggestions, we can use them to improve figrd without owing you anything for them - though we genuinely appreciate them.


6. Subscriptions, billing and renewals

figrd charges a subscription fee. Current pricing is on our website, in Australian dollars. Subscription payments are processed by Stripe; we don't store your card details. Your subscription renews automatically each billing period unless you cancel.

Price changes.If we increase the price of your plan, we'll give you at least 30 days' notice by email before the new price applies to you. If you don't want to continue at the new price, you can cancel before it takes effect.

Failed payments.If a renewal payment fails, we'll let you know and retry. If payment keeps failing, we may suspend access to paid features until it's sorted. We won't delete your data over a failed payment.

Cancelling.You can cancel at any time. Cancellation takes effect at the end of your current billing period - you keep access until then. We don't charge exit fees or lock you in.

Some features are available as optional add-on modules, listed on our pricing page. You can add or remove modules at any time; changes take effect on your next billing cycle.

We don't offer refunds for unused portions of a billing period, except where required under the Australian Consumer Law (see section 22) or where these terms say otherwise (see section 24).


7. Fair use

figrd is a flat monthly price with unlimited users, offered on the basis of fair use. Your plan includes generous monthly limits - on things like jobs, quotes, invoices, documents, and messages - shown on our pricing page. These cover normal use by a trade or service business of your size. If your usage is well beyond that, or we see patterns that look like abuse, reselling, or automated bulk activity, we may contact you, apply reasonable limits, ask you to move to a plan that fits, or - for serious or repeated cases - suspend the account. We'll give you notice where it's practical to do so.


8. Taking payments from your customers

figrd lets you take card payments from your customers - for example, through payment links on invoices. These payments run on Stripe. To use them, you set up a Stripe account connected to figrd, and you enter into Stripe's own agreements directly with Stripe (including the Stripe Connected Account Agreement). Stripe may ask you for identity and business verification - that's their requirement, not ours.

Money your customers pay you flows through Stripe to you. We never hold your money.Stripe's processing fees, payout timing, and dispute processes are set by Stripe and shown in your Stripe account.

The payment itself is between you and your customer. You're responsible for delivering the work it relates to, for your own refund policy, and for responding to chargebacks or disputes your customers raise. We'll give you the records figrd holds to help with that, but we're not a party to the transaction and don't guarantee that your customers will pay you.


9. Quotes, invoices and documents you send

figrd generates quotes, invoices, and other documents from the information you enter. They're sent in your business's name, and they're your documents. You're responsible for their contents - the pricing, the scope of work, GST treatment, licence numbers, and anything else the law requires you to include for your trade and your state.

When your customer accepts a quote - including through a link or customer portal page figrd hosts for you - that acceptance creates an agreement between you and your customer. figrd records it and helps you act on it, but we're not a party to it, we don't vet your customers, and we don't guarantee they'll proceed or pay.

Links you share - hosted quotes, payment links, portal pages - are accessible to whoever holds the link. Share them with the people they're meant for, and tell us if a link needs to be cut off.


10. Messages you send through figrd

When you use figrd to text or email your customers - quote follow-ups, on-the-way messages, reminders, campaigns - you're the sender. You're responsible for those messages and for having the right to contact those people. You must follow the law, including the Spam Act 2003: get consent, identify yourself, and honour opt-outs.

figrd handles SMS opt-outs automatically: if a customer replies STOP, we stop commercial messages to them on your behalf. Don't try to work around an opt-out - that's both a breach of these terms and, most likely, the law.

Messages travel over carrier and provider networks we don't control, so we can't guarantee a particular message will be delivered or delivered on time. If we see messaging patterns that look like spam or abuse, we may pause messaging features on your account while we sort it out with you.


11. Your customers' information

The customer details you enter - names, phone numbers, emails, addresses, job notes, photos - are yours to provide lawfully. You're responsible for having a proper basis to collect and use them, and for meeting any privacy obligations that apply to your business.

We process that information on your behalf, only to run the features you use, as described in our Privacy Policy. We don't sell it, and we don't contact your customers for our own purposes.


12. Estimates, costs and figures

A lot of figrd's value is in the numbers it shows you - profitability on a quote, effective hourly rates, travel and fuel estimates, margin by job. Those figures are calculated from the information you enter plus reference data (like indicative fuel prices, travel distances, and typical licence or compliance costs).

They are estimates to inform your decisions, not guaranteed outcomes. Reference data can be out of date or not match your situation; travel times vary; your real costs are whatever they really are. Check figures that matter before you rely on them, and use your own judgement on pricing.

Nothing figrd shows you is financial advice, and you're responsible for the business decisions you make using the platform.


13. AI-assisted features

Some figrd features use AI to help you work faster - for example, drafting quote descriptions or suggesting replies. AI-generated content is a starting point, not a finished product: it can be wrong, incomplete, or oddly worded. Review anything AI-assisted before you send it to a customer. Once you send it, it's your content, as with anything else you send through figrd.

How data is handled by AI features is covered in our Privacy Policy.


14. Integrations and third-party services

figrd is built on, and connects to, services run by others - payment processing (Stripe), maps and address lookup, SMS and email delivery, hosting, and optional integrations such as accounting software. Where you connect a third-party service to your account, that service's own terms apply to your use of it, and you authorise us to exchange your data with it as needed to make the integration work.

We choose our providers carefully, but we don't control them. If a third-party service changes, degrades, or withdraws what it offers, we'll do our best to adapt, but we're not responsible for their conduct or downtime - subject always to your rights under the Australian Consumer Law.


15. The mobile app

The figrd mobile app is part of the platform and these terms apply to it. If you download it from an app store, that store's terms also apply to the download itself.

Some mobile features use your device's location - for example, capturing your start address or sharing your position with your team while travelling to a job. Location features are optional and permission-based: the app works without them, and you control the permission in your device settings. Details are in our Privacy Policy.


16. Your data is yours

Everything you enter into figrd - your client list, jobs, quotes, costs, photos - belongs to you. We don't claim ownership of it. You grant us a limited licence to host, store, process, and transmit that content solely to provide the service to you. We don't use it for purposes beyond running your account and, if you turn it on, de-identified data to help us improve the product (see our Privacy Policy).

You can export your data at any time. When you close your account, we delete your data as described in the Privacy Policy - so export anything you want to keep first.

We back up the platform to protect against failures on our side, but figrd isn't a substitute for your own record-keeping obligations. Keep copies of documents the law requires your business to keep.


17. Availability, support and maintenance

We work to keep figrd fast and available, and most maintenance happens without you noticing. Sometimes we'll need planned maintenance windows; we'll aim to schedule them outside Australian working hours and give notice for anything significant. Like any online service, we can't promise 100% uptime.

Support is by email at support@figrd.com.au. We're a small Australian team; we read everything and aim to respond quickly on business days.


18. Security

We take security seriously: encrypted connections, access controls that keep each business's data separated, and infrastructure from reputable providers. Our Privacy Policy describes this in more detail.

Security is shared, though. Use a strong, unique password, keep your devices secure, and remove access for people who leave your business. If you find a security problem in figrd, please tell us at support@figrd.com.au before telling anyone else - we'll take it seriously and act quickly.


19. Intellectual property

The figrd platform - its name, logo, code, design, and the reference data we've compiled - is owned by figrd (ABN 62 646 753 794). These terms give you a non-exclusive, non-transferable right to use the platform for your business while you have an account. They don't give you any other rights in it.

Your data and the content you create in figrd (quotes, job descriptions, client records) are yours, as section 16 says.


20. Acceptable use

figrd is for running your business. You agree not to:

  • Use it for illegal activity of any kind.
  • Try to reverse-engineer, copy, or resell the platform or its underlying technology, or build a competing product from it.
  • Attempt to access other users' data or accounts, or probe or test the platform's security without our written permission.
  • Use automated tools to scrape or extract data in bulk.
  • Send spam, unsolicited communications, or misleading quotes or invoices through the platform.
  • Upload anything malicious, or anything you don't have the right to upload.
  • Interfere with the platform's operation or place unreasonable load on it.

If you breach these terms, we may suspend or terminate your account (see section 24).


21. Privacy

How we collect, use, store, and delete personal information - yours and your customers' - is set out in our Privacy Policy. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.


22. Your consumer rights and our liability

Your Australian Consumer Law rights

Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (ACL), including any consumer guarantee that cannot lawfully be excluded. If you're a consumer under the ACL, you have guarantees that the service will be provided with due care and skill, that it will be fit for its stated purpose, and that it will be provided within a reasonable time. These guarantees apply regardless of anything else in these terms.

Outside of your ACL rights, we provide figrd on an “as is” basis. We don't guarantee the platform will be available 100% of the time or completely error-free. We do our best to keep it running well, but we can't promise perfection.

To the maximum extent permitted by law (and subject to your ACL rights), we're not liable for indirect or consequential losses - for example, lost profits or business opportunities - arising from your use of or inability to use the platform. We're also not liable for disputes between you and your customers, for whether your customers pay you, or for the contents of quotes, invoices, and messages you send.

Where our liability can't be excluded but can be limited, it is limited (at our choice) to re-supplying the service or paying the cost of having the service re-supplied. Where that limitation doesn't apply, our total aggregate liability to you under these terms is capped at the amount you paid us in the 12 months before the event giving rise to the claim.

Indemnity.You agree to cover us for claims, losses, or costs brought by third parties that arise from your misuse of figrd, the messages and documents you send through it, or how you handle your customers' information - except to the extent we caused them. Nothing in this clause limits your rights under the Australian Consumer Law.


23. Events beyond our control

Neither of us is responsible for delays or failures caused by things genuinely outside our reasonable control - natural disasters, internet or power failures, carrier outages, or acts of government. Whoever is affected will do what's reasonable to get back on track. This doesn't excuse paying amounts already owed.


24. Suspension and ending your account

By you. You can cancel and delete your account at any time from your account settings. Export your data first - deletion is genuine (see section 16).

By us.We may suspend or terminate your account if you materially breach these terms, if your use creates legal or security risk, if payment has failed and stayed unresolved after notice, or if we're required to by law. For anything short of serious or deliberate misuse, we'll warn you and give you a chance to fix the problem first, and we'll give notice where practical and safe.

If your account is suspended or terminated for breach, we'll still provide you an export of your data on request, unless the law prevents us.

If we terminate your account without cause on our end - for example, if we wind down a service - we'll give you reasonable notice, time to export your data, and a refund of any unused subscription period.


25. Changes to figrd and to these terms

figrd improves continuously - features will be added, changed, and occasionally retired. If we remove something material to how you use the platform, we'll give you reasonable notice.

We may also update these terms from time to time. If we make material changes, we'll notify you by email at least 14 days before they take effect. Continued use of figrd after that date means you accept the updated terms. If you don't agree with the changes, you can cancel your account before they take effect - and if a material change disadvantages you, you can ask us to refund the unused part of your current billing period.


26. Disputes and governing law

If something's wrong, talk to us first - support@figrd.com.au. Most problems are fixable quickly, and we'd rather fix them than argue about them. Each of us agrees to try in good faith to resolve any dispute informally before going further.

These terms are governed by the laws of Victoria, Australia. Disputes that can't be resolved informally are subject to the jurisdiction of the courts of Victoria. Nothing in this clause limits any rights you have under the Australian Consumer Law, or your right to go to a tribunal or regulator.


27. The general bits

  • Entire agreement. These terms, plus the Privacy Policy and the plan details on our pricing page, are the whole agreement between us about figrd.
  • Severability. If part of these terms turns out to be unenforceable, the rest still stands.
  • No waiver.If we don't enforce a term on one occasion, that doesn't mean we've given it up.
  • Assignment.You need our consent to transfer your account or these terms to someone else (we won't unreasonably withhold it - for example, if you sell your business). We may assign these terms as part of a sale or restructure of our business, and we'll tell you if we do.
  • Notices.We'll send notices to the email address on your account, so keep it current. You can send notices to support@figrd.com.au.
  • Survival. Sections that by their nature should survive the end of your account - like data ownership, liability, and disputes - do survive it.
